Anniversary Dates

Employees who occupy positions in the Administrative, Operational or Institutional Services units, Professional, Scientific and Technical Services unit, Rent Regulation Services unit or Division of Military and Naval Affairs unit receive annual performance advances based on their anniversary date of service in the grade.

General Rules

A. Original appointment or promotion to a grade

In employee initially appointed to a grade with no previous service or promoted to a higher grade with no credit for previous service in any higher grade, has an anniversary date of the date of appointment or promotion. (Administration Cycle and CSEA BU’s are used in the examples unless otherwise noted)

B. Demotion

An employee demoted to a lower grade has an anniversary date as if all service of the higher grade had been rendered in the lower grade.

Example:
April 13, 2000, appointed Grade 5
June 21, 2001, promoted Grade 9
May 23, 2002, returns Grade 5
(With no breaks in service)

When employee returns to grade 5, their anniversary date reverts back to the original date of April 13, 2000.

C. Promotion followed by demotion and re-promotion

An employee promoted to a higher grade, who is demoted and subsequently re- promoted, has an anniversary date in the higher grade based on the original promotion date extended by the number of full payroll periods of the interim service in the lower grade.

Example:
April 13, 2000, appointed Grade 5
June 21, 2001, promoted Grade 9
May 23, 2002, returns Grade 5
August 15, 2002, re-promoted Grade 9
(With no breaks in service)

The original promotion anniversary date of June 21, 2001 is revised to September 13, 2001 extended a total of 6 payroll periods (which is the number of periods in the lower grade (May 23, 2002- August 15, 2002).

D. Unallocated (NS) to grade

Example:

The date on which the NS salary equaled or exceeded the then grade 14 hiring rate ($29213) was March 19, 1998; this date becomes the grade 14 anniversary date.

E. Interrupted service

An employee that has less than full pay status (i.e. lost time, leave without pay, sick leave with half pay), the anniversary date will be extended for each complete payroll period on leave. Payroll periods in which some service is performed does not affect the anniversary date

F. Reallocation

An employee who receives a salary increase due to reallocation of their position, retains the original anniversary date of appointment of the prior position.

Administrative, Operational, Institutional and Rent Regulation Services Units

Employees whose positions were reallocated under the April 1987 Job Evaluation action, who received an increment/advance of the higher grade on the date of reallocation and whose salary remained below the job rate of the higher grade, have their anniversary date changed to April 1 for payment of their next advance/increment. When these employees again attain the job rate in the reallocated position, the anniversary date reverts back to the original date of appointment to the position.

G. Reclassification to a lower position

An employee whose position is downgraded due to reclassification, retains the original anniversary date of appointment to the former higher grade position unless the employee had prior service in a lower grade that would result in an earlier anniversary date.

H. 10-Month Institution Teachers

All 10-month Institution Teachers have an anniversary date of September 1.

1. A teacher who is appointed in sufficient time to render 150 work days of service to qualify for a performance advance the following September 1, has an anniversary date that reflects the year in which the teacher commenced employment.
2. A teacher who does not render 150 work days of service and does not receive a performance advance the following September 1, has an anniversary date revised to the next year when it is expected they will render 150 days of service.

I. Lateral transfer between negotiating units

Employees who occupy positions designated in any of the negotiating units and lateral transfer to an Administrative, Operational or Institutional Service, Professional, Scientific and Technical Service, Rent Regulation Service, or Division of Military and Naval Affairs Unit receive service credit, however, anniversary dates may have to be revised from an appointment date to the date when the last performance advance was paid.

1. Examples:
   
   A former management/confidential employee, who received a performance advance, would have an anniversary date of April 1.
   
   A former management/confidential employee who never received a performance advance, would have the original date of appointment to the position as the anniversary date.
2. A former security employee who received an advance on April 1 would retain April 1 as their anniversary date.
   
   A former security employee who never received an advance on April 1 would retain the original date of appointment to the position as their anniversary date.

J. Transfer of Function

An employee whose former function was in another government municipality or corporation (public or private) that is assumed by New York State has an anniversary date based on the date of appointment to the New York State payroll.
